By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

4. ACCOUNTS AND REGISTRATION

4.3 Account Termination

We reserve the right to suspend, restrict, or terminate your Account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Extended periods of inactivity
• Requests from law enforcement
• Technical or security concerns

4.4 Guest Access

Guest Users are granted limited access to the Service, subject to daily usage limits. Guest access may be modified, restricted, or terminated at any time without notice.

5. SERVICE DESCRIPTION AND AVAILABILITY

5.1 Service Features

Safari AI Pro provides AI-powered conversational assistance, including but not limited to:

• Natural language processing and response generation
• Document analysis (PDF, DOCX, text files)
• Web search integration
• Voice-to-text transcription
• Multi-chat session management

5.2 Availability

While we strive to maintain continuous availability, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Third-party service disruptions
• Network or infrastructure issues
• Force majeure events

5.3 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

6. PRICING AND PAYMENTS

6.1 Free Tier

Guest Users receive a limited number of free queries per day. Registered Free plan users receive a higher daily limit as specified on the Service.

6.2 Paid Plans

Paid plans (Pro, Enterprise) are subject to the pricing published on the Service. All payments are:

• Non-refundable unless otherwise required by law
• Non-transferable
• Subject to change with 30 days notice

6.3 Taxes

You are responsible for all applicable taxes, duties, or fees associated with your use of the Service.

7. ACCEPTABLE USE POLICY

7.1 Illegal Activities

• Using the Service for any unlawful purpose
• Generating content that is defamatory, libelous, or slanderous
• Creating material that promotes violence, terrorism, or extremism
• Facilitating fraud, scams, or deceptive practices
• Violating intellectual property rights
• Distributing malware, viruses, or malicious code

7.2 Harmful Content

• Hate speech or discrimination based on race, religion, gender, sexual orientation, disability, or national origin
• Harassment, bullying, or intimidation of any individual or group
• Sexually explicit content involving minors
• Graphic violence or glorification of harm
• Content that causes psychological or emotional harm

7.3 Technical Abuse

• Reverse engineering the Service
• Scraping, crawling, or data mining without authorization
• Overloading, flooding, or crashing the Service
• Bypassing security measures or rate limits
• Impersonating others or misrepresenting affiliation
• Creating multiple accounts to circumvent limits

7.4 Commercial Misuse

• Using the Service to develop competing products
• Reselling or sublicensing the Service without authorization
• Using the Service for spam or unsolicited marketing

8. INTELLECTUAL PROPERTY

8.1 Service Ownership

Safari Softwares retains all rights, title, and interest in and to the Service, including all software, code, design, logos, trademarks, and documentation. Nothing in these Terms grants you any rights to the Service except as expressly stated.

8.2 User Content

You retain ownership of content you submit. However, by submitting content, you grant Safari Softwares a non-exclusive, worldwide, royalty-free license to process, store, and use your content solely for the purpose of providing and improving the Service.

8.3 AI-Generated Content

Content generated by the AI in response to your queries may be used by you for personal or commercial purposes. However, you acknowledge that:

• AI-generated content may not be accurate
• You are solely responsible for verifying any AI-generated information
• Safari Softwares makes no warranty regarding AI-generated content

8.4 Trademarks

"Safari AI," "Safari Softwares," and associated logos are trademarks of Safari Softwares. You may not use these marks without prior written permission.

9. PRIVACY AND DATA

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

• We process data only as necessary to provide the Service
• You have the right to delete your data

10. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, Safari Softwares disclaims all warranties including:

• Merchantability — fitness for a particular purpose
• Non-infringement — freedom from intellectual property violations
• Accuracy — correctness of AI responses
• Reliability — uninterrupted or error-free operation
• Security — freedom from viruses or harmful components

You acknowledge that AI-generated content may be inaccurate, incomplete, or misleading. You are solely responsible for verifying any information before relying on it.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Safari Softwares shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Third-party claims arising from your use of the Service
• Errors or omissions in AI-generated content

In no event shall Safari Softwares' total liability exceed the amount paid by you (if any) in the 12 months preceding the claim, or USD if you have not paid for the Service.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Safari Softwares, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

13. TERMINATION

13.1 By You

You may terminate your Account at any time by contacting us or using the delete-data feature. Termination does not affect any obligations accrued prior to termination.

13.2 By Us

We may terminate or suspend your access at any time for:

• Violation of these Terms
• Illegal or fraudulent activity
• Security concerns
• Non-payment (for paid plans)
• Any other reason at our discretion

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data after a reasonable retention period
• Sections 8, 10, 11, 12, 14, and 15 survive termination

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes shall be resolved through the following process:

1. Negotiation — Parties shall attempt to resolve the dispute informally within 30 days
2. Mediation — If negotiation fails, parties shall attempt mediation
3. Arbitration — Binding arbitration in Nairobi, Kenya

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis only and waive any right to participate in class actions or class arbitrations.

15. MISCELLANEOUS

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Safari Softwares regarding the Service.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

15.4 Assignment

You may not assign your rights under these Terms. Safari Softwares may assign its rights without notice.

15.5 Modifications

We may modify these Terms at any time. Continued use after modification constitutes acceptance of the modified Terms.
